These Terms and Conditions ("Terms") govern the use of the website relivexhealth.com and the purchase of products offered by ReliveX. Please read them carefully before placing an order.

In these Terms, "we," "us," "our," or "ReliveX" refer to Blackend Limited in its capacity as operator of the ReliveX store.

2. Purpose and Acceptance

These Terms apply to every order placed on relivexhealth.com. By placing an order, you confirm that you have read and accept these Terms without reservation.

We reserve the right to amend these Terms at any time. The version in effect on the date of your order will apply.

3. Legal Capacity

By placing an order, you declare that you are at least 18 years of age or have parental authorisation, and that you have full legal capacity to enter into a contract.

4. Products

Products offered on relivexhealth.com are described with the greatest care. Photographs are provided for illustrative purposes and may show slight variations in colour or appearance compared to the product delivered (in particular, depending on your screen's calibration). Such variations cannot give rise to our liability.

Products are offered subject to availability. If a product becomes unavailable after your order is placed, we will notify you and refund the item concerned.

5. Price and Payment

Prices are shown in Australian dollars (AUD), inclusive of GST where applicable. Any additional fees are disclosed before final confirmation of your order. Payment is due immediately and is made online using the methods available at checkout.

We reserve the right to change our prices at any time; however, products will be invoiced at the price in effect at the time your order is recorded.

6. Formation of the Contract

The presentation of products on relivexhealth.com does not constitute a legally binding offer, but rather an online catalogue. When you click "Pay" or an equivalent button, you are making an offer to purchase. The confirmation email you receive acknowledging your order does not constitute acceptance: the contract is finally concluded when your order is shipped.

8. Returns and Refunds

Australian Consumer Law does not provide a general statutory right to cancel or return an online order simply because you change your mind — that right applies only to certain specific contract types (such as unsolicited door-to-door or telephone sales), not to standard online retail purchases.

As a commercial policy, and independently of any legal entitlement, ReliveX offers customers a 30-day return period from the date of delivery. This commercial return period is in addition to, and does not affect, your statutory consumer guarantee rights described in Clause 9 below.

9. Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded.

Under the Australian Consumer Law, our goods come with guarantees that cannot be excluded, including that they are of acceptable quality, fit for the purpose for which they are commonly supplied, and match any description provided. If a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, or refund, depending on whether the failure is major or minor.

10. Liability

To the maximum extent permitted by law, we will not be liable for any indirect or consequential loss, nor for any loss resulting from misuse or negligence on the part of the customer. To the extent permitted by law, our liability is limited to the amount of the relevant order.

These limitations do not apply in cases of fraud, wilful misconduct, or where liability cannot lawfully be limited or excluded, including in respect of the consumer guarantees described in Clause 9.

11. Force Majeure

We will not be held liable for any delay or failure to perform resulting from an event of force majeure, including (without limitation) natural disasters, strikes, pandemics, logistics disruptions, or government-imposed restrictions.

12. Intellectual Property

All content on relivexhealth.com (text, images, logos, trademarks, videos) is protected by intellectual property rights and remains the exclusive property of Blackend Limited or its partners. Any reproduction, representation, or use, in whole or in part, without prior written authorisation, is prohibited.

13. Personal Data

The processing of your personal data is governed by our Privacy Policy, available at https://relivexhealth.com/pages/privacy-policy.

14. Prohibited Uses

You must not use the site or its content for any unlawful or fraudulent purpose, or in any way that infringes the rights of third parties. Any breach may result in the immediate termination of your access to our services.

15. Governing Law and Disputes

These Terms are governed by the laws of Australia.

If a dispute arises, you may contact us directly at info@relivexhealth.com so that we can work towards an amicable resolution.

You may also raise a complaint with the Australian Competition and Consumer Commission (ACCC) or your relevant state or territory consumer affairs office for information about your rights.

Failing an amicable resolution, the courts of Australia will have jurisdiction, at the consumer's choice, in the location of their residence or the place of delivery.
